These Terms and Conditions are for your protection as well as ours. If you require clarification on any points, please don't hesitate to ask.

Full payment is due on booking, unless otherwise agreed.

We take every precaution to supply a stable connection in order to livestream your event. Should the connection fail for any reason, we will upload a recorded version to your livestream link as quickly as possible.

In the event of heavy snow or any other act of God that prevents us attending the service a full refund will be given. We will aim to provide an alternative solution.

Cancelling or moving the date agreed may result in forfeiting any fees paid.

By providing us with an order, you accept the terms and conditions in full.

1. Definitions & General Terms
In these Terms and Conditions the word ‘Clarity Media’ 'FuneralStream' ‘we’ ‘the company’ ‘us’ ‘our’ and ‘ours’ refer to Clarity Media Services Ltd. The words ‘client’ ‘customer’ ‘your’ and ‘you’ refer to the party who commissioned and/or funded the work and any person or organisation acting on their behalf.
The term ‘video’ refers to the product and service with which we will supply you. The term “footage” refers to the media content captured by our cameras and audio equipment during the service. The term “pre-production” refers to the planning and organisation process which takes place before the service. The term “production” refers to the gathering of, or intention to gather, media content (including footage) for use in your service. The term “post-production” refers to the process of importing, editing and encoding the media content for your service, combining this with any additional material including graphical and musical elements.
These Terms and Conditions apply to all video, and associated audio products created by FuneralStream including all moving and still images and sound recordings of whatever form.
2. Supply
2.1 A contract is formed between us and you when an order is accepted from you.
2.2 An order may be in written, verbal or in electronic form.
3. Payment
3.1 To secure the provision of our services, a full payment is required at the time of booking.

4. Aborting filming & or changing pre agreed filming date.
4.1 In the event of you wishing to change or delay the service on the agreed date you agree to forfeit any fees paid.

5. Cancellation / Postponement / Equipment substitution or failure.
Our right to cancel
5.1 We reserve all rights to terminate our provision of service to you at any time.
5.2 In the event of our cancellation the payment made will be fully refunded. Reasons for cancellation may include, but are not limited to, staff illness, short notice medical or family emergencies, or natural/human disasters/events.
5.3 In the unlikely event that we experience equipment failure or difficulties, all efforts will be made to find suitable replacement equipment as soon as possible.
5.4 Internet connection provided by us is not guaranteed however we take every precaution to supply a stable stream. Whilst it's normally not an issue, if the signal drops or is not sufficient we will upload a recorded version asap.
5.5 We cannot be held responsible for down time, technical errors or problems with any content delivery network like Vimeo, Facebook or Youtube etc.
5.6 In the event of heavy snow or any other act of God that prevents us attending the service a full refund will be given.
5.7 If we supply a satellite connection, we cannot be held responsible for any breaks in this connection if the dish position arranged is not available on the day or the position is changed from the agreed location. The satellite requires uninterrupted line of site.
6. Your right to cancel
6.1 You reserve all rights to terminate the provision of our services at any time. If you wish to cancel please email claritymediauk@hotmail.com
6.2 If the funeral service date falls within 14 days of the date you confirmed the booking with us, then you waiver the right to your statutory 14 day cooling off period. If cancellation is made, a refund will be issued but this will exclude reasonable charges incurred in the preparation of this broadcast by our team.
6.3 Cancellation can be made the day before the funeral but not once the live broadcast has taken place.

7. Health & Safety & Insurance
7.1 We reserve the right in all instances to remove any of our personnel and / or equipment from a location if we think it to be unsafe or if our crew are subjected to abusive or aggressive behaviour. In such circumstances you will be liable for any costs incurred or subsequently arising as a result.
7.2 We will observe the site safety rules at all times and will liaise with the appropriate Responsible Person(s) at the venue.
7.3 We carry public liability insurance cover of five million pounds. A copy of our insurance certificate can be provided on receipt of a request to our offices.
8. Storage of your footage and files after the service.
8.1 After the service is complete the stream will be available for a minimum of 30 days, unless otherwise agreed.
8.2 We will archive this footage for a min of 12 months at our expense after which time it will be deleted.
9. Copyright
9.1 The Copyright of all material that has been captured by us is solely owned by us and protected under UK Law.
9.2 We will, in some instances, and upon prior agreement, transfer the Copyright ownership to you. This will be clearly specified in your written quotation.
9.3 We reserve the right to sensitively use some of the service for promotional purposes. The name of the deceased will never be shared publicly.
9.4 We do not give permission for any material to be altered, edited or used as part of another production, unless this is expressly agreed in writing.
10. Material provided by client
10.1 In the event of you providing material (video, audio, photographs, logos etc) for inclusion into our production, copyright must first be obtained from the original copyright owner / material provider.
10.2 You will be responsible for any future possible claims, disputes, expenses or similar that may arise from a third party concerning usage of such material.
11. Confidentiality
11.1 Unless otherwise agreed we will treat any information gained during the supply of the service(s) as being private and confidential. Likewise, you will keep confidential any methodologies and technology used by us in the delivery of such service(s).
12. Rights Reserved
12.1 Should we choose not to enforce any or all of these conditions it should not be interpreted as a waiver of any of our rights.
12.2 By providing us with an order, you accept these terms and conditions.
13. Basis of Law
13.1 These Terms and Conditions and any accompanying letter and/or contract are governed by the laws of England.
All Terms and Conditions stated within this document override any Terms and Conditions from you.
